Article 1: General Provisions

The e-commerce website of SOGO keramiek, a CommV with its registered office at Te Nijverdoncklaan 32, 2650 Edegem, Belgium, VAT BE0755.571.701 (hereinafter 'SOGO keramiek') offers its customers the ability to purchase products from its online store.

These General Terms and Conditions ("Terms") apply to every order placed by a visitor to this e-commerce website (“Customer”). When placing an order via the SOGO keramiek web store, the Customer must expressly accept these Terms, agreeing to their applicability and excluding all other terms. Additional terms from the Customer are excluded unless expressly accepted in writing by SOGO keramiek beforehand.

 

Article 2: Price

All listed prices are expressed in EURO, always including VAT and any other taxes or fees required to be paid by the Customer.

If delivery, reservation, or administrative fees are charged, this will be indicated separately.

The stated price applies only to the items as described. The accompanying photos are for decorative purposes and may contain elements not included in the price.

 

Article 3: Offer

Despite the utmost care in compiling the online catalog and e-commerce website, it is possible that the information provided is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer are not binding for SOGO keramiek. SOGO keramiek is only obligated to a best-efforts commitment regarding the accuracy and completeness of the provided information. SOGO keramiek is not liable for manifest material errors, typesetting, or printing mistakes.

If the Customer has specific questions regarding sizes, colors, availability, delivery times, or delivery methods, we request that the Customer contact our customer service beforehand.

For retail, there is a specific offer listed in a (digital) catalog. This catalog can be requested by merchants through the website.

The offer is valid while stocks last and can be adjusted or withdrawn by SOGO keramiek at any time. SOGO keramiek cannot be held liable for the unavailability of a product. If an offer has a limited validity period or is subject to conditions, this will be clearly stated in the offer.

 

Article 4: Online Purchases

The Customer can select items to place in a shopping cart. When viewing the shopping cart, the price (including VAT) of the products will be listed. Possible shipping costs will be displayed separately (including VAT). Shipping costs may vary depending on the chosen product, the shipping country, and whether the shipment is to a home address or a pickup point.

The Customer can choose from the following payment methods:

  • By credit card

  • By debit card

  • By bank transfer to account number BE72 7360 7530 6016

In addition to using the webshop, there is also the option to place an order by contacting SOGO keramiek. In this case, a quote will be provided with a clear indication of the goods to be delivered, including quantity, color, and delivery method. By approving the quote, the Customer agrees to these general terms and conditions.

SOGO keramiek reserves the right to refuse an order due to a serious breach by the Customer related to orders involving the Customer.

 

Article 5: Delivery and Execution of the Agreement

Once payment is received, the product will be shipped via bpost, DPD or PostNL, within 3 working days. SOGO keramiek cannot be held liable for any delays in delivery. Delivery costs are included and shown separately when purchasing a product via the webshop. If a separate order is placed, possible delivery costs will be clearly stated.

Items ordered through this web store are delivered to Europe. Orders outside Europe are possible on certain conditions. 

For custom orders, delivery to other countries can also be arranged in consultation with SOGO keramiek.

Delivery times for B2B customers are clearly predetermined. On average, these are 6 weeks but may vary depending on the size of the order and the workload in the workshop. SOGO keramiek strives to keep delivery times as short as possible.

The minimum value for orders from B2B customers to benefit from the discount rate as indicated in the catalog is 350 euros (retail price, including VAT).

Delivery is made by bpost, DPD or PostNL. SOGO keramiek reserves the right to deviate from these couriers.

Unless otherwise agreed or expressly stated, goods will be delivered to the Customer's residence within 30 days after receipt of the order via the webshop.

Any visible damage and/or quality defects of an item or other deficiencies upon delivery must be reported by the Customer to SOGO keramiek without delay.

When delivering products on consignment, it is the Customer's responsibility to protect the products from damage (breakage, theft).

The risk of loss or damage passes to the Customer once they (or a designated third party who is not the carrier) physically takes possession of the goods. However, the risk passes to the Customer at delivery to the carrier if the carrier was instructed to transport the goods and this choice was not offered by SOGO keramiek.

 

Article 6: Retention of Title

The delivered items remain the exclusive property of SOGO keramiek until full payment is received from the Customer.

The Customer agrees to inform third parties of the retention of title of SOGO keramiek if necessary, for example, to anyone who might seize the not fully paid-for items.

 

Article 7: Right of Withdrawal

The provisions of this article apply only to Customers who, as consumers, purchase items online from SOGO keramiek.

The Customer has the right to withdraw from the agreement within 14 calendar days without giving reasons.

The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, takes physical possession of the goods.

To exercise the right of withdrawal, the Customer must inform:

by means of a clear statement (e.g., in writing by post or email) of their decision to withdraw from the agreement.

To meet the withdrawal deadline, the Customer must send their communication regarding the exercise of the right of withdrawal before the withdrawal period has expired.

The Customer must return the goods promptly, but in any case no later than 14 calendar days after the day on which they communicated their decision to withdraw from the agreement to SOGO keramiek, Te Nijverdoncklaan 32, 2650 Edegem, Belgium.

The Customer is timely if they send back the goods before the 14-calendar-day period has expired.

The direct costs of returning the goods are the responsibility of the Customer.

The Customer is requested to return the items in their original condition and packaging. If the returned product has diminished in value in any way, SOGO keramiek reserves the right to hold the Customer liable and seek compensation for any loss in value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.

All returned items will be carefully inspected. The starting point is that the consumer may only inspect the item as they would in a store. Returned items must not have been used. If an item has diminished in value due to Customer use, this will be charged to the Customer.

If the Customer has requested that services begin during the withdrawal period, the Customer will pay an amount proportional to what has already been delivered at the time they informed us of their decision to withdraw from the agreement, compared to the full performance of the agreement.

If the Customer withdraws from the agreement, SOGO keramiek will refund all payments received from the Customer, including standard delivery costs, within a maximum of 14 calendar days after SOGO keramiek has been informed of the Customer's decision to withdraw from the agreement. In the case of sales agreements, SOGO keramiek may withhold the refund until all goods have been returned.

Any additional costs resulting from the Customer's choice of a delivery method other than the cheapest standard delivery offered by SOGO keramiek will not be refunded.

SOGO keramiek will refund the Customer using the same payment method as the one used for the original transaction, unless the Customer has expressly agreed otherwise; in any case, the Customer will not incur any costs for such a refund.

The Customer cannot exercise the right of withdrawal for:

  • Service agreements after the full performance of the service

  • Delivery of goods made to the Customer's specifications (on order, via the approval of a quote), or clearly intended for a specific person

  • Agreements for services for betting and lotteries

 

Article 8: Warranty

Under the law of September 21, 2004, concerning the protection of consumers in the sale of consumer goods, the consumer has legal rights. This legal warranty applies from the date of delivery to the first owner. Any commercial warranty does not affect these rights.

To claim the warranty, the Customer must be able to provide proof of purchase. Customers are advised to keep the original packaging of the goods.

For items purchased online and delivered to the Customer's home, the Customer should contact SOGO keramiek's customer service and return the item at their own expense to SOGO keramiek.

If a defect is found, the Customer must notify SOGO keramiek as soon as possible. In any case, any defect must be reported within 14 days after discovery by the Customer. After this period, the right to repair or replacement expires.

The (commercial and/or legal) warranty does not apply to defects resulting from accidents, neglect, falls, use of the item contrary to its intended purpose, failure to follow the usage instructions or manual, alterations or modifications to the item, rough handling, poor maintenance, or any other abnormal or incorrect use.

Defects that manifest after a period of 6 months following the date of purchase, or delivery, are presumed not to be hidden defects unless proven otherwise by the Customer.

Article 10: Sanctions for Non-Payment

Without prejudice to the exercise of other rights available to SOGO keramiek, in the event of non-payment or late payment, the Customer shall, from the date of default and without notice, owe interest of 10% per annum on the unpaid amount. Additionally, the Customer shall, from the date of default and without notice, owe a fixed compensation of 10% of the relevant amount, with a minimum of 25 euros per invoice.

Without prejudice to the foregoing, SOGO keramiek reserves the right to reclaim any unpaid items.

 

Article 11: Privacy

The data controller respects Belgian law of December 8, 1992, concerning the protection of privacy in the processing of personal data.

The website and webshop were created with Wix. Wix manages and provides the tools through which SOGO keramiek collects data from people who contact SOGO keramiek via the contact form or subscribe to the website.

The personal data you provide will only be used for the following purposes:

  • Sending occasional newsletters (with explicit consent)

  • Contact

  • Sending quotes and invoices

You have a legal right to access and, if necessary, correct your personal data. With proof of identity (copy of ID card), you can request a written communication of your personal data from SOGO keramiek - sogokeramiek@gmail.com free of charge. If necessary, you can also request correction of data that is incorrect, incomplete, or irrelevant.

In the case of use of data for direct marketing: You can object free of charge to the use of your data for direct marketing. You can always contact SOGO keramiek - sogokeramiek@gmail.com.

We treat your data as confidential information and will not disclose, rent, or sell it to third parties.

The Customer is responsible for keeping their login details confidential and for the use of their password. Your password is stored encrypted, so SOGO keramiek does not have access to it.

SOGO keramiek keeps online (anonymous) visitor statistics (e.g., Google Analytics) to see which pages of the website are visited and to what extent.

Article 12: Use of Cookies

Article 13: Invalidity of Provisions – Non-Waiver

If a provision of these Terms is declared invalid, illegal, or null, this will not affect the validity, legality, and applicability of the other provisions.

The failure of SOGO keramiek at any time to enforce any of the rights listed in these Terms, or to exercise any right thereof, will never be considered a waiver of such provision and will not affect the validity of these rights.

 

Article 14: Amendment of Terms

These Terms are supplemented by other conditions explicitly referenced and the general sales conditions of SOGO keramiek. In the event of a conflict, these Terms take precedence.

 

Article 15: Proof

The Customer accepts that electronic communications and backups can serve as evidence.

 

Article 16: Applicable Law – Disputes

Belgian law applies, excluding the provisions of international private law regarding applicable law.

The courts of the Customer’s place of residence have jurisdiction for judicial disputes. The Customer can also turn to the ODR platform (http://ec.europa.eu/consumers/odr/).
